Learned Senior Counsel for the petitioner wants to withdraw
this criminal miscellaneous second bail application.
The criminal miscellaneous second bail application is
dismissed accordingly. However, looking to the fact that the
petitioner is in custody for last about five years and all the
remaining prosecution witnesses are police personnel, this Court
deems it just and proper to request the learned trial Court to
expedite trial and conclude the same at earliest.
Since, all the remaining prosecution witnesses are police
personnel, the concerned Superintendent of Police, District Deeg is
directed to ensure their presence as and when called for by the
learned trial Court.

It is made clear that failure thereof, would be viewed
seriously by this Court.
The Registrar (Judl.) is directed to remit a copy of this order
