1. Leave granted.

2. The appellant has been arraigned as an accused in Case Crime

No. Nil of 2024 registered with Police Station – A.I.U. Customs,

L.B.S.I. Airport, District – Varanasi, Uttar Pradesh, for the

offence(s) punishable under Section 135 of the Customs Act, 1962.

3. Learned counsel for the appellant submits that although the

offence is bailable, the bail bonds could not be executed. In any

case, the appellant has been incarcerated for seven months.

4. Taking note of the aforesaid position, we set aside the

impugned order passed by the High Court and allow the present

appeal. The appellant shall be released on bail in connection with

the aforesaid case, subject to the terms and conditions that may be

imposed by the Trial Court.

5. Pending application(s), if any, shall stand disposed of.
