1. Heard learned Counsel for the petitioners and learned

Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out

of Belaganj Police Station Case No. 194 of 2022,

disclosing offences punishable under Sections

147/148/149/341/323/ 324/307/379/448/504 of the Indian

Penal Code.

3. The prosecution case, as per the First Information Report,

is that on 06.05.2022, at about 11 AM, the petitioners,

along with other co-accused persons, started digging the

public lane and when the informant protested, all the

accused persons abused him and the petitioner no. 1

assaulted him by means of garasa, due to which he

sustained head injury. The petitioner no. 2 assaulted the

daughter-in-law on her hand, co-accused Mantu Yadav

assaulted Keshami Devi and snatched her gold locket and

ear-ring, the petitioner nos. 3 and 4 assaulted the

grandson of the informant and the petitioner no. 5

assaulted one Usha Devi by brick.

4. Learned Counsel for the petitioners submits that the

petitioners are innocent and have falsely been implicated

in this case due to land dispute. He further submits that

both the parties are agnates and there was a dispute with

regard to the passage between the parties. He further

submits that five persons, including the informant, have

sustained injuries, but all are simple in nature caused by

hard and blunt substance.

5. Regards being had to the submissions advanced on behalf

of the parties and taking into consideration the fact that

both the parties are angates, there appears to be previous

land dispute between the parties and the injuries sustained

by the informant and others are simple in nature, I am

inclined to grant the petitioners privilege of anticipatory

bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their

arrest or surrender before the Court below within a period

of four weeks from today, be released on bail on

furnishing bail bonds of Rs. 10,000/- (ten thousand) each

with two sureties of the like amount each to the

satisfaction of learned 2nd Additional Chief Judicial

Magistrate, Gaya, in connection with Belaganj Police

Station Case No. 194 of 2022, subject to the condition

laid down under Section 438 (2) of the Code of Criminal

Procedure.
