1. In view of the fact that this is a jail petition and the same
has been filed with the assistance of the Supreme Court Legal
Services Committee, the delay is condoned.
2. This is a Special Leave Petition arising from the judgment
dated 07.05.2010 whereby, the Division Bench of the High Court,
dismissed the Criminal Capital (Jail) Appeal No. 4346/2007 filed by

Reason: petitioner and affirmed his conviction as recorded by the
learned Sessions Judge, Mahoba in Sessions Trial No. 78/2006. By

the said judgment, the learned Sessions Judge recorded the verdict
of conviction against the petitioner and the co-accused Raju Basor
for the offences punishable under Section 302 IPC and Sections
376/34 IPC. While the petitioner was sentenced to imprisonment for
life on the count of Section 302 IPC and 10 years on the count of
Section 376 read with Section 34 IPC, the co-accused, Raju Basor
was awarded death penalty. The said death penalty, however, was
not confirmed by the High Court in the reference forwarded under
Section 366 Cr.P.C. The Special Leave Petition preferred by the
State against the non-confirmation of the death penalty stands
rejected by this Court with an order dated 18.11.2011 in SLP
(Criminal) No. 008916/2011.
3. Having heard and considered the submissions advanced by
learned counsel for the petitioner and after going through the
impugned judgment, we find that the High Court has re-appreciated
the entire evidence available on record extensively and came to an
independent finding for affirming the judgment of the trial court
in convicting the petitioner and sentencing him as above. The
prosecution case was founded on the testimony of the eye-witnesses,
PW-1, PW-2 and PW-6, which we find to be unimpeachable.
Furthermore, the evidence of these witnesses is also corroborated
by the medical testimony.
4. In this background, we are not inclined to entertain the
instant Special Leave Petition, which is dismissed as such.
5. Pending application(s), if any, shall stand disposed of.
