2. This appeal is against the judgment and
order passed by the High Court of Judicature at
Bombay rejecting an application filed on behalf

13(1)A read with Section 13(2) of the Prevention
of Corruption Act, 1988 and Sections 409, 465,
466, 467, 468, 471, 120-B of the Indian Penal
Code, 1860.
3. Having heard the learned counsel for the
appellant as also the respondent-State, we are of
the opinion that the appellant can be granted the
benefit of anticipatory bail.
4. While issuing notice on 27.01.2025, this
Court granted interim protection to the appellant
pending disposal of the Special Leave Petition.
5. In view of the fact that an amount of
Rs. 3,12,23,729/- (Rupees Three Crore Twelve
lakh twenty three thousand seven hundred and
twenty nine) out of alleged embezzled amount of
Rs. 3,16,58,421/- (Rupees Three Crore sixteen
lakh fifty eight thousand four hundred and
twenty one) has already been deposited by the
Criminal Appeal @ SLP (Crl) No. 1128 of 2025 2
accused person(s), we deem it appropriate to
confirm our order dated 27.01.2025.
6. In the event the appellant is arrested in
connection with FIR No.32 dated 14.10.2024, he
shall be released on bail on such terms and
conditions as may be imposed by the Trial Court.
7. We make it clear that the appellant shall
fully cooperate with the investigation. In case
the appellant does not cooperate with the
investigation, State is at liberty to move the
Trial Court for cancellation of anticipatory
bail.
8. The appeal is accordingly allowed.
