Heard learned counsel for the petitioner and learned
APP for the State
2. The petitioner apprehends his arrest in connection
with Taraiya P.S Case No. 349 of 2023 registered for the
offences punishable under Sections 147, 148, 149, 341, 323,
325, 183, 427, 188, 189, 353, 333, 307, 356, 354(b) of Indian
Penal Code.
3. As per the prosecution case, total 75 litres of illicit
liquor were recovered by the police.
4. Learned counsel for the petitioner submits that
petitioner has been falsely been implicated in this case. It is also
submitted that petitioner is not arrested on the spot, no recovery
from the conscious possession of the petitioner. It is further

submitted that co-accused has already granted anticipatory bail
by the Co-ordinate Bench of this Court in Cr. Misc. No. 14256
of 2024. It is next submitted that petitioner has got no criminal
antecedent as stated in para 3 of the bail petition.
5. Learned counsel for the State opposes the prayer
for bail of the petitioner.
6. Considering the aforesaid facts and circumstances
of the case, submissions made on behalf of the petitioner, let the
above named petitioner be released on bail in the event of his
arrest or surrender before the trial court within a period of six
weeks from today on furnishing bail bond of Rs. 10,000/- (Ten
thousand) with two sureties of the like amount each to the
satisfaction of learned Exclusive Special Judge, Excise II, Saran
at Chapra in connection with Taraiya P.S Case No. 349 of 2023
subject to the condition laid down under Section 438(2) of
Cr.P.C.
