perm anent resident of Ward No. 4, Thapaliya Mehra
Gaon, Nakuchiat al, Bhim t al, Dist rict Nainit al. His nam e
is recorded in t he elect oral roll of Nagar Palika
Parishad, Bhim t al, Local Bodies Elect ions, 2024 at serial
no. 774. The pet it ioner want s t o cont est t he elect ion t o
t he post of Chairm an, Nagar Palika Parishad, Bhim t al.
The Addit ional Secret ary, Urban Developm ent
Depart m ent , Governm ent of Ut t arakhand has issued a
t ent at ive Not ificat ion dat ed 12.12.2024. The pet it ioner

has subm it t ed his obj ect ions dat ed 17.12.2024 t o t he
respondent no. 1 against reserving t he post of
Chairperson Nagar Palika, Parishad, Bhim t al for OBC
( Mahila) . The said obj ect ions are st ill pending.
Therefore, t he pet it ioner has filed t he present writ
pet it ion under Art icle 226 of t he Const it ut ion of I ndia
wit h t he following prayers:
” ( i) I ssue a writ , order or direct ion in t he nat ure of
m andam us direct ing t he respondent no. 2 t o decide
t he obj ect ions of t he pet it ioner dat ed 17.12.2024 sent
t hrough Dist rict Magist rat e Nainit al on 18.12.2024 by
a speaking, r easoned and well consider ed or der aft er
affording due opport unit y of hearing t o t he pet it ioner
while provisionally not ifying t he post of Chair person
Nagar Palika Parishad, Bhim t al, Dist rict Nainit al as
OBC ( Mahila) . ( cont ained in Annexure No. 5 t o t his
writ pet it ion) ;
( ii) I ssue any ot her writ , or der or dir ect ion which
t his Hon’ble Court deem s fit and proper.”
