1. The present interim bail application has been filed under

Section 439 Cr.P.C. on behalf of the petitioner, who is in

judicial custody in connection with F.I.R. No.102/2023

registered at P.S. Dangiawas, Dist. Jodhpur City East for the

offences under Sections 332, 353 and 307 of the IPC and

Section 8/15 of the NDPS Act and Sections 7 and 27/3 and

25(1-B)(a) of the Arms Act.

2. By way of filing the instant temporary bail application, the

petitioner has sought his temporary release on the ground

that the grand mother of the appellant had passed away on

24.02.2025 and her cremation was done on the same day.

The appellant being her grand son would require to perform

Hindu rituals and other customary rites.

3. Learned counsel for the State has verified the fact of death of

grand mother of the appellant.

4. I have heard the learned counsel for the petitioner and the

learned Deputy Government Advocate and gone through the

material available on record.

5. Considering the submissions advanced by the learned counsel

for the petitioner and taking a humanitarian view of the

matter, this Court is inclined to grant temporary bail of 30

days to the petitioner.

6. Accordingly, the temporary bail application is allowed. The

petitioner shall be released on bail for a period of 30 days

from the date of his actual release provided he furnishes a

personal bond in the sum of Rs.50,000/- along with two

sound and solvent sureties in the sum of Rs.25,000/- each to

the satisfaction of Superintendent of Central Jail, Jodhpur.

After verification and attestation, the Superintendent of

Central Jail, Jodhpur shall forward the sureties and bonds to

the Court concerned when the Court will open. The order

shall be effective from the date of the petitioner’s release.

7. The petitioner shall surrender before the concerned Jail

Authority in the morning of the next day of completion of the

period of temporary bail.
