1. Heard learned counsel for the appellant, learned A.G.A. for the State and perused the record.

2. The instant Criminal Appeals under Section 374 (2) Cr.P.C. has been filed by the appellant impeaching the judgment and order 08.08.2003 passed by the Additional Sessions Judge/Fast Track Court No.3, Sitapur in Sessions Trial No.224/1999 (State vs. Paragi and others) arising out of Case Crime No.29/1998, under Sections 452, 307 I.P.C. Police Station – Rampur Kalan, District Sitapur thereby convicting and sentencing the appellant under Section 324 and 452 I.P.C. for two years’ rigorous imprisonment with fine of Rs.2,000/- and in default of payment of fine three months’ additional imprisonment and three years’ rigorous imprisonment with a fine of Rs.2000/- and in default of payment of fine he has to undergo six months’ additional imprisonment.
