1. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.

Present writ petition has been filed by the petitioner inter-alia with the prayer to quash the order dated 10.05.2016 passed by the respondent no.3-District Magistrate, Gorakhpur in Case No.D2012053100807 (State vs. Ram Daras) under Section 17(3) of the Arms Act, 1959 and order dated 15.01.2021 passed by the respondent no.2-Commissioner Gorakhpur Division, Gorakhpur in Appeal No.1000 of 2018 under Section 18 of the Arms Act, 1959.

It is argued by the learned counsel for the petitioner that the petitioner is having firearm license No.3387 for Revolver No.A-6075/32 and the aforesaid license of the petitioner was cancelled only on the ground that Case Crime No.1678 of 2010 under Sections 147, 323, 353, 395, 171, & 186 of the I.P.C and 135 & 136 of Representation of the People Act and Case Crime No.33 of 2010 under Sections 147, 452, 325, 323, 504, 506 & 427 is pending against the petitioner.
