1. The appellant has filed the instant appeal under Section 19(1) of
the Family Court Act, 1984 against the impugned judgment & decree
dated 27.06.2023 passed in Civil Suit No. 06/2022 passed by the
learned Family Court, Manendragarh Camp, Baikunthpur, District Koriya
C.G., whereby the learned Family Court allowed the petition under
Section 10 read with Section 25 of Guardians and Wards Act 1890 and
handed over the custody of the minors namley Sagun, Armaan &
Shivani to the respondent herein. Therefore, the present appeal filed by
the appellants.
2. During the pendency of appeal both the parties agreed for
amicable settlement and vide order dated 27.01.2025, the matter was
referred to Mediation Centre of this Court and both parties have settled
their dispute before the Mediation Centre on the same day, wherein
statements of both the parties got recorded and compromise was
arrived at between the parties in terms of the settlement agreement
dated 27.01.2025, which was duly signed by them.
3. The settlement agreement dated 27.01.2025 is as under:-

माननीय उच्च न्यायालय के आदेश दिनांक 27.01.2025 के परिपालन में यह
प्रकरण क्रमांक FA (MAT) No. 233/2023 (Ram Prasad Khairwar Vs.
Soniya) में पक्षकारों के मध्य उपयुक्त तिथि दिनांक 27.01.2025 को मध्यस्थता प्रक्रिया
संपन्न किया।
मध्यस्थता प्रक्रिया के अनुरूप पक्षकारों के मध्य एकल एवं संयुक्त सत्र मध्यस्थता
के न्द्र छत्तीसगढ़ उच्च न्यायालय, बिलासपुर में दिनांक 27.01.2025 को उपयुक्त रूप से
आयोजित किया गया।
आज दिनांक को उपयुक्त अंतिम निर्णय की स्थिति में पहुँच चुके हैं और उनके मध्य
विवाद स्वेच्छासे पूर्ण सहमति के साथ सभी विवादों का निपटारा कर एवं आपसी वैचारिक
मंथन एवं विवाद को खत्म करने हेतु सहमत हैं।
दोनों पक्षकारगण निम्नलिखित शर्तों पर बिना भय, प्रलोभन एवं दुर्मति के अपने
स्वविवेक के नीचे दिये गये शर्तों पर सहमत हैं :
1. यहीं के दोनों पक्षकारगण आपस में समझौता किये की अपीलार्थगण अपने घर को
बहुत उत्तरदायिनी सोनिया को अपने साथ अपने गृहग्राम हर्रि, थाना एवं तहसील अनूपपुर,
जिला अनूपपुर (म.प्र.) में रखने को तैयार हैं।
2. सोनिया उत्तरदायिनी अपनी ससुराल में जाकर रहने को तैयार हैं जहाँ उसके तीनों
बच्चे रह रहे हैं वह उत्तरदायिनी भी अपने ससुराल परिवार व बच्चों के साथ आगे हँसी-खुशी
जीवन यापन करना चाहती हैं व बच्चों के संरक्षण को लेकर उत्तरदायिनी द्वारा किसी भी
प्रकार का बाद-विवाद नहीं किया जायेगा।
3. यहीं कि उत्तरदायिनी अपने पिता शिवकु मार के साथ अपने ससुराल आज दिनांक
27.01.2025 से 15 दिनों के भीतर अपने ससुराल जाने को तैयार हैं व उत्तरदायिनी के
4ससुराल जाने की पूर्व से कोई बाद-विवाद की बात नहीं को लेकर वह एवं अपीलार्थगण
सहमत हैं।
4. उपयुक्त शर्ते आपस में एक-दूसरे से एवं परिवार वालों के साथ हँसी-खुशी रहेगें और
आगे भविष्य में किसी भी प्रकार का बाद-विवाद नहीं करेंगें।
5. उपयुक्त पक्ष समझौते के आधार पर किसी भी प्रकार का प्रकरण आगे नहीं चलाना
चाहते ना किसी अन्य न्यायालय में लंबित प्रकरण को भी आपसी सहमति से वापस लेने को
यदि होतो।
उपयुक्त इस समझौता पत्र की शर्तों एवं समझौते में शर्तें हैं पालन के लिए कटीबद्ध
हैं। समझौता पत्र में दी गई बातें जो उन्होनें अपने स्वविवेक एवं सहमति एवं बिना किसी
दबाव, भय एवं लालच से स्वीकार किया गया हैं उपयुक्त ने इस समझौता पत्र की शर्तों को
समझने एवं पढ़वाने उपरांत अपनी स्वतंत्र सहमति से एक-दूसरे की उपस्थिति में निष्पादित
किया हैं।
मध्यस्थता कार्यवाही में अपीलार्थी के अधिवक्ता श्रीमती वेदना शर्मा व उत्तरदायिनी
के पिता शिवकु मार द्वारा सहयोग प्रदान किया गया जिसके लिए उनका धन्यवाद ज्ञापित
किया जाता है।

4. Learned counsel for the parties jointly submit that the aforesaid
agreement has been arrived at between the parties without any
pressure or coercion and the same is out of their own free will, whereby
they have amicably resolved the dispute before the Mediation Centre of
this Court and therefore, the present appeal may be disposed of in
terms of the aforesaid agreement dated 27.01.2025.
5. We have heard learned counsel for the respective parties.

6. In view of the submissions made by learned counsel for the
parties and looking to the terms and conditions of the agreement dated
27.01.2025 arrived at between them, the present appeal is disposed of
in terms of the said agreement. The terms of the agreement will form
part of this judgment and decree.
7. Let a decree be drawn up accordingly.
8. Interlocutory application(s), if any pending, shall stand disposed
of.
