This judgment is emerged consequent upon the

petition filed by the petitioners U/Sec.166 of M.V. Act,

claiming compensation of Rs.40,00,000/- on account of

the death of Sri. Venkataramanna in a road traffic

accident.

2. The case of the petitioners, in brief, are as

follows:

On 26.10.2023 at about 12.30 p.m., the deceased

was going towards his village Gudipalli from

N.Vaddahalli by riding a TVS XL moped bearing

Reg.No.KA-07-ED-0019 and when he reached near

Yaluvalli Cross, on Mulabagal-Punganur road,

Mulabagal Taluk, Kolar District, the driver of KSRTC

Rajahamsa bus bearing Reg. No. KA-07-F-1675 drove the

same in a rash and negligent manner and came from

opposite direction i.e., from Punganur side and dashed

violently against the motor cycle in which the deceased

was proceeding. Due to the impact, the deceased fell

down and sustained grievous injuries and succumbed to

the said injuries on the spot. Thereafter, the deceased

dead body was shifted to Government Hospital,

Mulabagal, wherein, PM examination was conducted.

The deceased was hale and healthy and aged about 50

years at the time of accident. He was a mason mesthri

working under different employers and was earning

Rs.30,000/- per month and in near future he would have

earned more than Rs.50,000/- per month if he was alive.

He was the only bread earner of the family and

petitioners were entirely depending upon the earnings of

the deceased. Due to the untimely death of deceased the

petitioners are put to lot of mental agony and untold

misery and lost their bread earner.
