1. Heard learned counsel for the parties and perused the

material available on record.

2. The present bail application has been filed under Section 483

of Bhartiya Nagarik Suraksha Sanhita (B.N.S.S.), 2023/439 Cr.P.C.

on behalf of the petitioner, who is in custody in connection with

F.I.R. No.247/2024 dated 12.12.2024, registered at Police Station

Naal, District Bikaner, for the offences under Sections 64(2),

137(2) of B.N.S. and Section 3/4 and 16/17 of POCSO Act.

3. Learned counsel for the petitioner submits that the victim in

her statement under Section 161 & 164 Cr.P.C./183 BNSS stated

that on the day of incident i.e. 10.12.2024 at around 7 PM, she

had went to the agriculture field where she stayed with her

husband Ramesh (the present petitioner) for two days and with

her consent, she had consensual relationship with her husband.

Learned counsel for the petitioner further submits that at the time

of incident she was aged about 16 years and 8 months. Learned

counsel for the petitioner further submits that the petitioner is in

judicial custody since 14.12.2024 and the trial of the case will take

long time, therefore, the petitioner may be enlarged on bail.
