2. Though served, none appears on behalf of respondents
No. 2, 4 & 5 and respondent No.3 is unserved. Nonetheless,
the presence of such respondents is not required for
adjudication of the present writ application. It is reported
that suit is proceeded ex-parte against respondent No.3
having not appeared in the suit.
3. The present writ application is filed under Article 227 of
the Constitution of India seeking following relief :-
