26.03.2015, whereby the divorce application filed by the appellant-

husband under Section 13 of the Hindu Marriage Act been rejected by

the learned Additional District Judge, Sambhar Lake, Jaipur, this

appeal under Section 28 of the Hindu Marriage Act, 1955, has been

filed by him.

2. Facts which are relevant for the purpose of adjudication of

the dispute involved in the instant appeal are that on 22.10.2011, the

appellant-husband filed an application under Section 13(1)(i-a) and (i-

b) of the Hindu Marriage Act, 1955, against the respondent-wife,

contending therein that the marriage between the appellant-husband

[2025:RJ-JP:27183-DB] (2 of 15) [CMA-2200/2015]

and the respondent-wife was solemnized in the year 1997 according to

Hindu rites and customs. As a result of this wedlock, a daughter was

born, who presently resides with the respondent-wife and is about six

years old.
