Heard learned counsel for the petitioners and learned
A.P.P. for the State.
2. In the present case, the petitioners seek bail in
connection with Wajirganj P.S. Case No. 268 of 2021, registered
for the offences under Sections 341, 323, 504, 308, 427, 379/34
of the Indian Penal Code and later on Section 302 IPC was

added.
3. As per prosecution case, the petitioners and other
co-accused persons entered into the house of the informant and
abused and assaulted her. When the husband of the informant
intervened, he was assaulted by the assailants making him
unconscious. The husband of the informant was taken to the
hospital for treatment and during treatment, he died after 10
days.
4. Learned counsel for the petitioners submits that
petitioners are innocent and have been falsely implicated in this
case. Altogether 13 persons have been made accused in this case
with general and omnibus allegation. The occurrence took place
on 16.06.2021 and the husband of the informant died on
26.06.2021. The statement of the husband of the informant was
not recorded though he remained in hospital for ten days and
was quite conscious. The husband of the informant died due to
some illness as he was being treated in the private hospital, but
the injury report from the private hospital has not been brought
on record. There was old dispute between the parties and during
investigation, the witnesses stated that for settlement of old
dispute, both the parties had assembled and some scuffle took
place. The learned counsel further submits that a number of co-

accused persons have been granted regular bail by a Coordinate
Bench of this Court vide orders dated 12.01.2023, 15.05.2023
and 11.08.2023 passed in Cr. Misc. Nos.47482/2022, 2300/2023
& 50655/2023, respectively. The case of the petitioners is on
exactly similar footing. The learned counsel further submits that
the petitioners are in custody since 20.01.2025 and charge sheet
has been submitted. The petitioners are having clean
antecedents.
5. Learned A.P.P. vehemently opposes the submission
made on behalf of the petitioners. Learned A.P.P. submits that in
the assault by the petitioners, one person had lost his life.
6. Having regard to the fact and circumstances and
submission made on behalf of the parties and considering the
general nature of allegation against the petitioners, grant of bail
to similarly placed co-accused persons, submission of charge
sheet and period of custody of the petitioners, the petitioners are
directed to be released on bail, on furnishing bail bonds of
Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties
of the like amount each to the satisfaction of learned Additional
Chief Judicial Magistrate-1, Gaya/concerned court, in
connection with Wajirganj P.S. Case No. 268 of 2021, subject to
the conditions mentioned in Section 480 (3) of BNSS and also
Patna High Court CR. MISC. No.47328 of 2025(2) dt.30-07-2025

the following conditions :
(i) One of the bailors will be a close
relative of the petitioners.
(ii) The petitioners will remain present on
each and every date fixed by the below, if
so required by the learned trial court.
(iii) In case of absence on three
consecutive dates or in violation of the
terms of the bail, the bail bond of the
petitioners will be liable to be cancelled
by the court concerned.
