Heard the parties.
2. The petitioner is in custody in connection with
Suryapura P.S. Case No. 163 of 2024 for the offences
punishable under Sections 341, 323, 324, 325, 307, 504, 506/34
of the Indian Penal Code and later on Section 302 of the Indian
Penal Code was added lodged on 10.06.2024 by the informant,
Rohit Kumar.
3. As per the prosecution story, the informant alleged
that while he was moving alone, the accused persons assembled
and assaulted on his head. Allegation is against Ravishankar
Ram for giving iron rod on his head. When his uncle, Chunmun
Ram and father Sitaram came to rescue, allegation is that this
petitioner along with Jogindra Ram and Hridyanand Ram
besides Satyendra Ram made indiscriminate assault by lathi,
iron rod causing injuries. In the process, his brother was also

assaulted. This led to the FIR.
4. As the story unfolds, the uncle of the informant
succumbed to the injuries in the Emergency ward of the Patna
Medical College Hospital, Patna. In this case, co-ordinate bench
had called for the case diary on 19.05.2025 which is now
available and this Court is surprised to go through the injury
report submitted by the Dr. Anant Kumar, Medical Officer,
Primary Health Centre, Surajpura (Rohtas). All the injuries
to the injured (now deceased) have been recorded as simple in
nature with regard to Chunmun Ram. He has recorded others
injuries also as simple.
5. The injury report of Chunmun Ram is recorded in
paragraph 77 of the case diary as follows:
Sex- male S/o- Late Suraj Ram,
Village-Kawai P.S. Surajpura Dist- Rohtas, He
came to Phc Surajpura Rohtas on Er Token No-
678, Date 09.06.2024, I found following injury:-
1) Lacerated wound present in left parietal
area of head,
a) Length approx- 2.5 cm, b) Breadth
approx- ½ cm
c) Deapth approx- 1.5 cm c) No of stitches

6. The nature of injury has been found to be
simple by the concerned Dr. Anant Kumar who

signed it on 09.06.2024.
7. The fact remains that considering the serious
injuries to the Chunmun Ram, he was shifted to the Emergency
ward of the Patna Medical College Hospital, Patna where he
succumbed to the said injuries on 15.06.2024 and the cause of
the death has been recorded as follows:
1. OPINION: Cause of Death :
Craniocerebral damage resulting from head
injury caused by hard and blunt impact free.
2. Time Since Death : 06 hrs to 24 hrs
(approx) prior to postmortem examination.

8. In that background, let the Superintendent of
Police, Rohtas at Sasaram request the Civil Surgeon cum Chief
Medical Officer, Rohtas to constitute an Enquiry Committee
consisting of the Doctors well conversant with the neuro injuries
who shall go through the initial injury report prepared by Doctor
Anant Kumar vis a vis the postmortem report prepared by the
Patna Medical College and Hospital, Patna and come to the
conclusion whether the findings arrived at by the Medical
Officer Dr. Anant Kumar was correct or not.

9. The Civil Surgeon, Rohtas shall be submitting the
Enquiry Report to the Superintendent of Police, Rohtas who
shall be filing the reply annexing the said report by 08.10.2025.
10. Let the name of Mr. Jitendra Kumar Singh,
learned APP appear in the cause list who shall be filing counter
affidavit on behalf of Superintendent of Police, Rohtas at
Sasaram.
11. List this case as a ‘Tied Up’ matter on 10.10.2025.
