This case is registered against the accused for the
offence punishable U/s 138 of Negotiable Instruments
Act.
2. Factual matrix of the complainant’s case is as
under:
The complainant is the Managing Director of M/s
Royal Chick India Pvt Ltd and the said company entered
into an agreement for sale in respect of property bearing
Sy.No.96/1, new Sy.No.96/5 of the converted land
measuring 6 acres situated at Navarathna Agrahara
Village, Jala Hobli, Bengaluru North Taluk with the land
owner Smt.P.Sheshakumari on 31.10.2011. The
complainant has paid the substantial sale consideration to
her. But she became hostile and failed to perform her part
of contact. Therefore, the complainant along with his
company filed Civil Suit for Specific Performance of the
Contract and for enforcement of agreement of sale
against the said Smt.P.Sheshakumari and also M/s
Hrudaya Holdings Pvt Ltd before Hon’ble Civil Judge (Sr.
Dn) at Devanahalli in O.S.N o.603/2014. In the said case an
interim order granted against Smt.P.Sheshakumari and
M/s Hrudaya Holdings Pvt Ltd represented by one
Mr.Ramesh.G Patel on 09.09.2004. But subsequently
Smt.P.Sheshakumari along with M/s Hrudaya Holdings
Pvt Ltd joined hands with accused persons herein and
created registered sale agreement on 25.09.2014 by
violating the interim order passed in the said O.S.case.
