Selection was made from the subject panel. There were two
waitlisted candidates. Two incumbents who were appointed from the
panel resigned. The vacancy was filled through a public advertisement
and selection process.
According to the respondent, the panel was alive and the
candidates ought to have been chosen from the panel. Learned single
judge allowed the writ petition of the respondent.
At the time of hearing of this appeal on 3 rd April, 2025, learned
Deputy Solicitor General sought time to take instructions.

Today, he submits that there is further one resignation from the
panel in the unreserved category and his client is willing to
accommodate the respondent.
But the fact is that the respondent is No. 2 in the waitlist. The
first waitlisted candidate, although he has not come to Court has to be
noticed.
Advocate-on-Record for the appellants shall notice the first
waitlisted candidate giving him an opportunity to appear on the next
date of hearing.
List this appeal and the connected application for further hearing
on 24th April, 2025.
