This petition emanates from the Motor Vehicle Accident
dated 28.09.2022 wherein the petitioners have sought for
compensation with respect to the death of Aleem Ulla Sharif @
Alim Sharif due to the impact of the accident.
2. Succinctly stated the facts germane to the lis
involved in this petition are briefly summarized as follows:
It is the case of the petitioners that the petitioner No.1 is the
wife and petitioner No.2 and 3 are the sons of the deceased
Aleem Ulla Sharif @ Alim Sharif who died in the Road Traffic
Accident on 28.09.2022 due to the negligence of the driver of
the respondent’s lorry. It is submitted that on 28.09.2022 at
about 10.30 p.m., deceased Aleem Ulla Sharif @ Alim Sharif was
riding a bicycle on extreme left side of the road at Bharath
Petrol bunk, Mysore road, near BGS flyover, Bengaluru, at that
time, the respondent’s Cement Mixture Lorry bearing
Reg.No.KA-01-AC-3862 came with high speed in a rash and

negligent manner and dashed against the Aleem Sharif resulting
in the accident. As a result of the collision, the deceased
sustained fatal injuries and died on the spot.
