1. The instant appeal under Section 101 (5) of the
Juvenile Justice (Care and Protection of Children) Act, 2015
has been filed, assailing the order of rejection of bail by
Children’s Court on the ground that the CICL was charged
with the offence of POCSO Act and he required to be tried
under the said Act.
2. It is urged on behalf of the prosecution that
Section 34 of the POCSO Act lays down the procedure in
case of commission of offence by child and determination
of his age.
