1. This hearing has been done through hybrid mode.
CM APPL. 36806/2025 (for urgent direction in terms of order dated 6th
December, 2024) in MAT.APP.(F.C.) 374/2024

2. This is an application filed on behalf of the Respondent/Applicant
under Section 151 CPC, 1908 seeking urgent directions in terms of order
dated 6th December, 2024. The present application has been filed in
MAT.APP.(F.C.) 374/2024 which has been preferred by the Appellant-
Husband who, vide order dated 9th October, 2024, was inter alia directed to
pay maintenance to Respondent-Wife and his children in the following terms:

“46. Husband Rohan Nigam prima facie is a blue eyed
boy of his father and living a luxurious life while doing
work of his father and taking care of business of his
father and his immovable assets as well as rental
income. Keeping in mind above elicited criterias for
determining quantum of maintenance for wife Megha
Nigam and minor daughter Nandini and minor son
Vansh; in the fact of the matter and keeping in mind the

elicited material on record, including lavish lifestyle of
husband Rohan Nigam; earnings of husband Rohan
Nigam, financial resources available with husband
Rohan Nigam, in my considered opinion; the ends of
justice would be met by granting monthly maintenance
of (1) Rs.60,000/- for accommodation, food, social
obligations, transportation, toiletries, clothing etc. for
wife Megha Nigam, (ii) Rs.60,000/- for
accommodation, food, social obligations,
transportation, medication, toiletries, clothing etc. for
minor daughter Nandini; (iii) Rs.60,000/- for
accommodation, food, social obligations,
transportation, medication, toiletries, clothing etc. for
minor son Vansh; (iv) Rs.80,000/- for medical
treatment of wife Megha Nigam for Chronic Kidney
Disease (CKD), stage 5, requiring her to undergo
dialysis multiple times (2 or 3 times a week); since each
such dialysis requires amount of Rs.5000/- to Rs 6000/-
approximately; (v) husband Rohan Nigam shall
continue to pay educational expenses of daughter
Nandini and son Vansh including their respective
educational fees in their schools before payable date,
for which needful shall be done by wife Megha Nigam
by (a) providing complete particulars of such fees and
school; (b) for adding name of husband Rohan Nigam
in school records and mobile number(s) in relevant
records and Apps, if any, to facilitate availing of
information by husband Rohan Nigam for such
payments, Aforesaid interim monthly maintenance
amount will be payable by husband Rohan Nigam to
wife Megha Nigara on 15 day of every English
calender month, which shall be payable from the date
of filing of interim maintenance application ie.,
11/12/2023 till disposal of this case. At this stage no
order is being passed for payment of litigation expenses.
Needless to say that in case of final adjudication, wife
Megha Nigam is held not entitled for maintenance, then
she shall be required to refund the received amounts

towards maintenance to husband Rohan Nigam as per
law.”

3. Vide order dated 6th December, 2024, upon hearing the parties, the
Court had certain directions in the following terms:

“9. There are substantial arrears of more than Rs. 30
lakhs to be paid, as per the Respondent. Considering the
medical condition as also the schooling and living
expenses of the Respondent and the children, in the
meantime, the Appellant is directed to pay a sum of Rs.
6 lakhs by 15th December, 2024 to the Respondent by
way of direct bank transfer to the Respondent’s bank
account. A further sum of Rs. 6 lakhs shall be paid by
15th January, 2025. 10. It is submitted by learned
Senior Counsel for the Respondent that the wife is
exploring kidney transplant and if the donor is
identified, she will require funds for kidney
transplantation as well. The Respondent is at liberty to
move an application if the donor is identified along
with the requisite documents. Rejoinder, thereto, if any
be filed within 2 weeks.”

4. A perusal of the above order shows that the Respondent-Wife, who is
undergoing dialysis, was permitted to file an application if a donor is
identified for kidney transplant. Today it is informed that the donor has been
identified.

5. Ms. Priya Hingorani, ld. Senior Counsel appearing for the Respondent
submits that apart from the amount for the transplant surgery, in terms of the
directions issued by the trial court, more than a sum of Rs.1 crore is due qua
maintenance.

6. The Court has repeatedly queried Mr. Jauhar, ld. Counsel appearing for
the Appellant as to what is the due amount of maintenance in terms of the

order passed by the trial court. No exact amount is forthcoming.

7. Under such circumstances, issue notice in the application. Notice is
accepted by Mr. Prabhjit Jauhar, ld. Counsel for the Appellant/ Non-
Applicant. Let a reply be filed within two weeks.

8. In the meantime, considering the amount of maintenance, which is
stated to be due as also the need for the transplant surgery, it is directed that a
sum of Rs.20 lakhs shall be paid by the husband to the wife within a period
of two weeks from now.

9. List this matter before the Roster Bench on 9th July, 2025.
