Learned Advocate for the petitioner seeks accommodation
to serve upon the de facto complainant/victim.
Learned Advocate for the State also submits that the Case
Diary has not been produced.
Learned Advocate for the petitioner is directed to file
affidavit-of-service on the returnable date.
State is directed to effect service and file a service report
on the returnable date. In the notice to be served by the State, it
should be mentioned that the de facto complainant/victim has a

right to be represented through a lawyer to be engaged by the
Calcutta High Court Legal Services Committee for which no cost
need be borne by the de facto complainant/victim. The notice
should be in a language which the de facto complainant /victim
can comprehend.
State is also directed to file status report of the trial on
the returnable date. In the status report to be filed, the State
shall indicate the stage of the trial, the number of charge sheet
named witnesses, the number of witnesses examined so far, how
many more witnesses the prosecution proposes to examine,
whether or not the petitioner has criminal antecedents and any
other relevant fact.
