Learned counsel appearing on behalf of the petitioner has

submitted that the petitioner is not involved in this case under

Sections 103/3(5) of the Bharatiya Nyaya Sanhita, 2023 (in

short, ‘BNS’). He has further submitted that nothing has been

revealed against this particular petitioner during investigation.

2. Learned counsel appearing on behalf of the State, on the

other hand, has relied on the evidence collected during

investigation, particularly, the statement recorded under

Section 164 of the Code of Criminal Procedure (Section 183 of

the BNSS). It is further submitted that all arrested accused of

this case are still in custody and this particular petitioner was

found absconding.

3. After careful perusal of the statements of witnesses

recorded under Section 183 of the BNSS as well statement

recorded under Section 161 of the Code of Criminal Procedure

(Section 180 of the BNSS), I am not inclined to enlarge the

petitioner on anticipatory bail.

4. This application for anticipatory bail is, thus, rejected.

5. All parties shall act on the basis of a server copy of this

order duly downloaded from the official website of this Court.

6. Criminal Section is directed to supply certified copies of

this order to the parties, if applied for, upon compliance of all

necessary formalities.
