1. Heard learned counsel for the parties as well as perused the

material available on record.

2. The instant application for bail has been filed under Section

483 BNSS on behalf of the petitioner, who is in custody in relation

to F.I.R. No.637/2024 dated 07.11.2024, registered at Police

Station Pilibanga, District Hanumangarh for the offence under

Section 366, 384, 376D, 354 of IPC.

3. Learned counsel for the petitioner submits that the petitioner

has falsely been implicating in the case while alleging that the

petitioner along with the co-accused Gurvinder Singh @ Gerry has

committed rape upon the complainant while blackmailing her that

[2025:RJ-JD:24474] (2 of 3) [CRLMB-2842/2025]

in case, she does not surrender herself then the accused would

viral her video to the family members. He submits that charge-

sheet has been filed, wherein, offence under Section 376 has not

been proved and offences under Section 354, 363, 384 & 120B

IPC have been found proved against petitioner, whereas, against

the Gurvinder Singh, who is the main accused, offences under

Section 376 (2) (n), 363, 354, 384, 120B IPC have been found to

be proved. He also submits that the main accused Gurvinder

Singh is absconding and no videos/pictures of the complainant

have been recovered from the petitioner on account which he

could have blackmailed the complainant and kidnapped her in

order to outrage her modesty.
