The present Application has been filed by the

applicant-Sandeep Kumar Thapa seeking anticipatory bail in the

Case Crime No.263 of 2025, registered at Police Station Nehru

Colony, District Dehradun under Sections 120B, 420, 467, 468,

471, 504 of the Indian Penal Code, 1860 and Section 24 of the

Emigration Act, 1983.

2. According to the First Information Report dated

29.07.2025, the applicant and co-accused had told the informant

that they would provide him a job in Finland. The informant gave

one lakh rupee to the applicant on 13.11.2024. Applicant and the

co-accused had given him a fake contract letter.

3. Heard Mr. Prem Kaushal, learned counsel for the

applicant and Mr. Tumul Nainwal, learned Assistant Government

Advocate for the respondent nos.1 and 2.

4. Mr. Prem Kaushal, Advocate submitted that as per the

First Information Report, the entire fraudulent act is attributed to

co-accused Upendra Singh Thapa. Applicant did not receive any

amount from the informant. He had not given any assurance to

the informant. He is a permanent resident of District Dehradun,

therefore, there is no likelihood of his absconding, and, he does

not have any criminal antecedents.

5. Mr. Tumul Nainwal, Assistant Government Advocate,

on instructions, has sought three weeks’ time to file objection to

the anticipatory bail application.

6. Time is granted.

7. Notice is being issued to the respondent no.3. Steps

to be taken within a week.

8. Having heard the learned counsel for the parties and

in the facts and circumstances of the case, as an ad-interim

measure, it is directed that in the event of arrest of the

applicant-Sandeep Kumar Thapa, he shall be released on interim

bail on executing a personal bond of Rs.30,000/- and two reliable

sureties, each of the like amount, to the satisfaction of the

Investigating Officer/Arresting Officer, subject to the following

conditions:-

(i) Applicant shall cooperate with the Investigating
Agency and he shall make himself available for
interrogation by a police officer as and when required;

(ii) Applicant shall not directly or indirectly make any
inducement, threat or promise to any person
acquainted with the facts of this case.

(iii) Applicant shall not leave the country without the
previous permission of this Court.

9. List on 10.09.2025 for hearing on the anticipatory bail

application.
