This application for bail under Section 483 of BNSS (439
Cr.P.C.) has been filed by the petitioner who has been arrested in
connection with F.I.R. No.04/2025 registered at Police Station
Pratapnagar District Udaipur for offences under Sections 115(2),
126(2), 109(1), 117(2), 118(1), 324(2) and 3(5) of the BNS.
Heard learned counsel for the petitioner and learned Public
Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submitted that the
accused-petitioner has been falsely implicated in the present case.
The allegations against the present petitioner and the co-accused
are that one accused has caught hold of Dhan Singh and the
another accused stabbed with knife on the complainant on his
stomach, chick and hand. They were calling themselves by the

names of Sandeep and Manoj. Learned counsel submitted that no
injury has been caused by the present petitioner to Dhan Singh.
Learned counsel further submitted that as per report of the
Medical Jurist all the injuries received by Dhan Singh are not
dangerous to life. Learned counsel submitted that the petitioner is
19 years of aged and in judicial custody since 04.01.2025 and the
trial of the case will take sufficiently long time, therefore, the
benefit of bail may be granted to the accused-petitioner.
Per contra, learned Public Prosecutor has opposed the bail
application.
Having considered the rival submissions, facts and
circumstances of the case, without expressing any opinion on
merits/demerits of the case, this Court is inclined to enlarge the
petitioner on bail.
Consequently, the bail application under Section 483 of BNSS
(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner
Sandeep S/o Late Gehari Lal, arrested in connection with F.I.R.
No.04/2025 registered at Police Station Pratapnagar District
Udaipur, shall be released on bail, if not wanted in any other case,
provided he furnishes a personal bond of Rs.50,000/- and two
sureties of Rs.25,000/- each, to the satisfaction of learned trial
court, for his appearance before that court on each & every date
of hearing and whenever called upon to do so till completion of the
trial.
