01. 1. Heard learned counsel for the Petitioner and
learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in
connection with G.R. Case No.1023 of 2017 pending
in the Court of the learned S.D.J.M., Berhampur
arising out of Berhampur Town P.S. Case No.161 of
2017 for alleged commission of offence punishable
under Sections 417, 419, 420, 506, 294/34 of IPC.

3. It is stated that by order dated 02.05.2025,
the petitioner was directed to be released on bail in
ABLAPL No.4638 of 2025 subject to verification of
antecedent. It is also stated that inadvertently it
could not be brought to the notice of the Court that
the petitioner was cited as an accused in Berhampur
Town P.S. Case No.111 of 2024 under Section 3 of

the Orissa Prevention of Gambling Act and it is stated
on affidavit that the same has been disposed of in Lok
Adalat in 2009 and save and except the said case,
there is no other case against the present petitioner.
Hence, the petitioner may be permitted to be
released on pre-arrest bail.

4. Such submission is opposed by learned
counsel for the State.

5. Taking into account the nature of allegation
and the punishment prescribed, this Court directs that
on surrendering within three weeks hence and
moving for bail, the Petitioner shall be released on
bail by the learned Court in seisin on such terms as
deemed just and proper subject to verification of any
other antecedent except the aforesaid one as noted
above. In the event it is found that such submission is
incorrect, this order shall not be given effect to.

6. Accordingly, the ABLAPL stands disposed of.
