Petitioner is medical practitioner by profession. He is in
custody since 06.09.2024. Charge-sheet has already been
submitted on 29.09.2024 under Sections under Sections
498A/307/406 of the Indian Penal Code and Sections 3/4 of the
Dowry Prohibition Act against the petitioner.
2. As charge-sheet has been submitted, we feel further detention
of the petitioner is not necessary.
3. Considering the above facts and circumstances and materials
available on Case Diary, we are of the view that the petitioner
shall be released on bail.
4. Accordingly, the petitioner namely, Sarafat Ali @ Dr. Sarafat
Ali, shall be released on bail upon furnishing a bond of Rs.
10,000/- (Rupees Ten Thousand), with two sureties of like
amount, one of whom must be local, to the satisfaction of the
learned Additional Chief Judicial Magistrate, Barrackpore
subject to the condition that the petitioner shall appear before
the Trial Court on every date of hearing until further orders.
5. In the event the petitioner fails to do so without any justifiable
cause, the Trial Court shall be at liberty to pass necessary
order in accordance with law without any further reference to
this Court.
6. The application for bail, being CRM (DB) 4406 of 2024, is
accordingly disposed of.
