The present bail application has been preferred by the
petitioners under Section 483 of BNSS (Old Section 439 Cr.P.C.) in
connection with FIR No.05/2025 registered at Cyber Police
Station, District Bhilwara for the offences punishable under
Sections 316(2), 318(4) & 61(2) of BNS and under Section 66-D
of the I.T. Act.

2. Learned counsel for the petitioners submits that the
petitioners have falsely been implicated in this case, the main
accused in the case is one Ila Sharma, who allegedly lured the
petitioners on the pretext of offering them employment and
fraudulently took their cheque details. It is also submitted that Ila
Sharma later kidnapped the petitioners and misused their bank
accounts by depositing certain amounts, which were subsequently
withdrawn without the petitioners’ knowledge or consent. Further,
counsel submits that the names of the petitioners have not been
mentioned in the FIR and no recovery has been made from them.
It is further submitted that there are no other criminal
antecedents against the present petitioners other than the present
one and the offences alleged are triable by Magistrate and no case
for the alleged offences is made out against them and their
incarceration is not warranted. The accused-petitioners are in
judicial custody since long and the trial of the case will take long
time. Therefore, it is prayed that the accused-petitioners may be
enlarged on bail.
