1. Leave granted.
2. Heard the learned counsel appearing for the
appellant and the learned counsel appearing for the
respondent(s).
3. The present appeal arises out of the impugned
order dated 22.04.2025 passed by the High Court of
Judicature at Bombay, Bench at Aurangabad in Criminal
Appeal No. 107 of 2025, whereby, the High Court has
rejected the prayer of the appellant for grant of

bail, who has been arrayed as an accused in

Reason:
connection with Crime No.195/2022 registered with the
Cidco Police Station, Aurangabad for the offences

punishable under Sections 302, 143, 147, 148, 149,
120-B, 201 and 114 of the Indian Penal Code, 1860
along with Section 3(2)(v) of the Scheduled Castes
and Scheduled Tribes (Prevention of Atrocities) Act,
1989.
4. Learned counsel appearing for the appellant
would submit that the other co-accused persons have
already been granted bail. However, learned counsel
appearing for the State, while vehemently opposing
for the relief sought for, submitted that the
appellant is the main accused.
5. It is not in dispute that the appellant has
been under incarceration for nearly 03 years and 03
months.
6. Hence, taking note of the continued
incarceration, the fact that only 06 out of 43
witnesses have been examined till date, and the
further fact that the trial is likely to take some
more time for its completion, we are inclined to set
aside the impugned order and enlarge the appellant on
bail.
7. Accordingly, the impugned order stands set
aside, and it is directed that the appellant be
released on bail, subject to such terms and

conditions that may be imposed by the Trial Court.
8. The appeal stands allowed, accordingly.
9. Pending application(s), if any, shall stand
disposed of.
