Heard learned counsel for the petitioner and learned
APP for the State.
2. The petitioner seeks bail in connection with Ara
Muffasil P.S. Case No. 89 of 2024 instituted for the offence
under Sections 414, 420, 467, 468, 471, 120(B), 34 of the Indian
Penal Code and under Section 25(1-B)a, 26, 35 of the Arms Act.
3. As per the prosecution case, one criminal was
caught in a stolen truck by the police and he has named the
petitioner in his confessional statement on which the petitioner
has been implicated in this case.
4. The petitioner is in jail since 27.11.2024 and he
claims that he is named in only two more cases except the
present case.
5. Considering the facts of the case and the period
of custody, this application is allowed.

6. Let the petitioner, above named, be released on
bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)
with two sureties of the like amount each to the satisfaction of
the learned ACJM-VII, Bhojpur at Ara/concerned Court below
in connection with Ara Muffasil P.S. Case No. 89 of 2024,
subject to the condition that both the bailors should be close
relatives of the petitioner. It is also subject to the condition that
the, Court below, before accepting the bail bonds of the
petitioner, will verify the antecedent of the petitioner and if the
Court below finds that the petitioner is involved in any other
case except Kachhawa P.S. Case No. 89 of 2024 and Sandesh
P.S. Case No. 263 of 2024 then his bail bonds shall not be
accepted.
7. As a condition of this order, the petitioner after
being released on bail is directed to mark his attendance at
Narayanpur Police Station on every Sunday of each month. Any
default in appearance at the police station will result in
cancellation of bail bonds of the petitioner.
