3. The Petitioner has preferred the present writ petition in respect of the
National Eligibility cum Entrance Test (NEET) (UG) 2025 examination
conducted on 4th May, 2025, seeking certain reliefs including awarding of
compensatory marks and preservation of CCTV footage from the concerned
test centre.

4. The background is that the Petitioner appeared for the NEET UG
examination conducted on 4th May, 2025 between 2 pm to 5 pm, at the test
centre namely Trishla Devi Kanohar Lal Balika Inter College, Meerut, Uttar
Pradesh. The allegation of the Petitioner is that during the authentication
process, prior to the examination, the biometric verification did not work at

the test centre and Petitioner was made to file an application requesting
permission for entrance into the examination hall. Accordingly, the Petitioner
was permitted entrance into the examination hall only five minutes before the
commencement of examination. Thereafter, it is averred that while the
examination was underway, the Petitioner was asked to step out for the
biometric verification and he was made to submit an application in both
English and Hindi to the Centre Superintendent. This led to considerable
mental disturbance to him while giving the NEET UG examination.

5. The Court has perused the documents placed on record. In terms of the
result which has been declared, the Petitioner has scored, the following

6. The Petitioner’s prayer at this stage is for preservation of the CCTV
footage at the test centre as also the log book entries and any other evidence
that may be available so that the same is not destroyed and would be required
to support the case of the Petitioner.

7. The counselling date for the NEET UG is yet to be announced.

Counsel, on behalf of the Respondent No.1 – National Testing Agency
(hereinafter “NTA”).

9. Let the contentions in the writ petition be rebutted by the NTA by filing
a counter affidavit, specifically in respect of the allegations relating to the
biometric verification. In addition, the CCTV recordings, log book entries and
any other registers at the test centre shall also be preserved, subject to further
orders of this Court.

10. It is submitted by ld. Sr. Counsels for the Petitioner that the
compensatory marks may also be calculated in terms of the decision of the
Supreme Court in Writ Petition (Civil) No. 551 Of 2018 titled Disha Panchal
and Others vs. Union of India The Secretary and Others
. This submission
shall be considered on the next date after perusing the stand of the NTA in
respect of the allegations made qua the biometric verification.

11. The application under Section 151 of the Code of Civil Procedure, 1908
praying for interim reliefs, including, awarding of compensatory marks and
preserving of CCTV footage is taken on record. Let the said application be
numbered by the Registry.

12. Let the counter affidavit be filed by 25th June, 2025.

13. The submission on behalf of the Petitioner is that the counselling may
commence from 1st July, 2025. Accordingly, list before the Vacation Bench
on 27th June, 2025.
