Order on Board

12/03/2025 Heard Mr. Ankit Singh, learned counsel for the petitioners.

Also heard Mr. Hari Om Rai, Panel Lawyer, appearing for the

State/ Respondent and perused the impugned FIR as well as

charge-sheet and materials brought on record.

It has been contended by the learned counsel for the

petitioners that the marriage between the respondent No. 2-

Bhumika Goel (wife) and petitioner No. 1 was solemnized on

25.04.2022 as per the their rituals. After some time of marriage

some dispute arose between them. Subsequently, on 11.11.2022,

respondent No. 2 received a job offer from M/s SMEC for a

consultancy position in Banglore. During period of 2022 to 2023,

dispute arose between them was not solved and and when all the

attempts to resolve the dispute was failed, the respondent No. 2

refused to return to Mumbai in order to reside with petitioner No.

1 and the petitioner No. 1 had filed a divorce case, bearing case

No. 1487/2023 before Civil Court Senior Division Belapur,

Maharashtra on 10.08.2023. thereby, the respondent No. 2, only

to harass the petitioner No. 1 and his family members lodged a

false complaint before the Police Mahila Thana, Raipur on

03.01.2024 and registered an FIR bearing Crime No. 001/2024 .

On 24.09.2024, the Police filed the impugned final report before

learned JMFC Raipur, and sequentially the petitioner were

presented before the learned JMFC Raipur and the learned

JMFC vide impugned order dated 24.09.2024 taken cognizance

against the petitioner and proceeded with the matter. Learned

counsel for the petitioners submit that the present matter be

referred to Mediation & conciliation Centre of this Court being

matrimonial in nature as there are chances to compromise

between the parties.

Considering the fact that the dispute arrived at between the

parties is matrimonial in nature, we deem it appropriate to make

an effort to get the said dispute settled by way of mediation.

In view of the above, petitioner No.1/husband shall deposit

Rs. 50,000/- with the Mediation Centre of this Court within a

period of one week from today and the same shall be paid to

respondent No. 2/wife on her appearance before the Mediation

Centre. Parties are directed to appear before the Mediation

Centre of this Court on 24.03.2025.

Learned State counsel is directed to inform the private

respondent i.e. respondent No. 2 about passing of this order, so

that she may appear before the Mediation Centre on the

aforesaid date.

List this matter along with report of Mediation Centre

before this Court on 08.04.2025.

Till the next date of listing, further criminal proceeding of

Case No. 17487/24, pending before the learned Judicial

Magistrate First Class, Raipur arising out of the impugned FIR

dated 03.01.2024 (Annexure-P/1) registered at Police Station-

Mahila Thana, Raipur, Dist- Raipur (CG) under Section 498A/34

of IPC shall remain stayed.

It is made clear that in case the aforesaid amount is not

deposited within the aforesaid period, the interim protection

granted as above shall automatically be vacated and this petition

shall stand dismissed without further reference to any Bench of

this Court.

The petitioners are directed to produce the copy of the

receipt before the concerned trial Court regarding payment of the

said money before the Mediation Centre of this Court in

pursuance of this Court’s order, then only this order shall be given

into effect.

It is also made clear that if any final settlement is arrived at

between the parties, the aforesaid amount so deposited, shall be

adjusted.
