This judgment is emerged consequent upon the

petition filed by the petitioners U/S 166 of M.V. Act,

claiming compensation of Rs.50,00,000/- on account of

the death of Nagaraju K.C., in a road traffic accident.

2. The case of the petitioners, in brief, is as

follows:

On 23.09.2022 at about 6.10 p.m., the deceased

was proceeding as a pillion rider in Two wheeler bearing

Reg.No.KA-06-EW-5226 along with rider Shivaprasad

from Tumakuru side towards Kunigal side, while so

riding on the left side of said SH-33, Tumakuru-Kunigal

Road, behind Kunigal Doddakere, Kunigal Taluk,

Tumkuru Dist, a mini Goods vehicle bearing Reg.No.KA-

41-D-2787 came from Tumakuru side towards Kunigal

side came with speed in a rash and negligent manner

and dashed against the deceased’s two wheeler from

back side and caused the accident. Due to the impact,

the deceased sustained fatal injuries. Immediately, after

the accident, injured was shifted CHC, Kunigal provided

first aid treatment and thereafter shifted to KIMS

hospital, Bangalore and admitted as an inpatient for a

period of 6 days, underwent surgery to his fracture

injuries, but the efforts made by the doctors was not

fruitful and injured Nagaraju was succumbed to death

on 29.09.2022 at Victoria Hospital, Bangalore,

Postmortem was conducted and handed over the body to

the petitioners. Thereafter, they performed funeral

ceremonies at their native by spending Rs.80,000/- and

they have also spent Rs.2,00,000/- towards medical

treatment of the deceased.
