1. This application for bail under Section 483 of BNSS (Section

439 Cr.P.C.) has been filed by the petitioner, who has been

arrested in connection with F.I.R. No.31/2025, registered at Police

Station Bigod, District Bhilwara, for the offence under Sections

127(2), 64(2)(M) and 77 of BNS, 2023.

2. Heard learned counsel for the parties and perused the material

available on record.

3. It is contended by learned counsel for the petitioner that the

petitioner has been falsely implicated in the present case. As per

prosecution story, the petitioner is having some objectionable

photos and videos of the prosecutrix in his mobile because of

which he pressurized the victim ‘N’ to have physical relations with

him. Learned counsel submits that a missing report was registered

by the husband of the victim ‘N’ and in pursuance of this she was

apprehended by the Police and the petitioner was arrested on

28.02.2025. Learned counsel submits that as per the statement of

the victim ‘N’ she herself left her house with the petitioner and

travelled to nearby places on his motor cycle and has not made

any request for help in public places. Learned counsel draws the of

this Court towards that the recovery memo-mobile of petitioner in

which it mentioned that no videos and photos were found in the
