It is submitted on behalf of the petitioner that he is in no way

connected with the selection process for appointment of employees in

the Food department. The examination is undertaken by the office of

the Public Service Commission, West Bengal. No money was handed

over to him. Accordingly, he prays for anticipatory bail.

2. We have considered the allegations in the FIR. In the FIR it is

alleged petitioner had demanded money from the de-facto complainant

on the assurance that his name would appear in the list of successful

candidates for appointment in the Department of Food and Supplies,

Government of West Bengal. It is further alleged though the de-facto

complainant did not appear in the examination, his name had appeared

in the list.

3. Uncontroverted allegations are extremely disturbing and involve

corruption in the matter of selection of candidates for public

employment.

4. Learned Advocate for the State seeks time to file report with

regard to the authenticity of the list of purported successful candidates

published in the official website of the Public Service Commission, West

Bengal.

5. Taking note of the seriousness of the case, we direct the

investigation in the matter be transferred to the Inspector General,

Criminal Investigation Department (CID), West Bengal who shall

investigate the case through an experienced officer not lower than the

rank of Deputy Superintendent of Police (DSP).

6. Needless to mention if involvement of public servants in the

publication of fabricated list of successful candidates is detected, the

agency shall add offences under the Prevention of Corruption Act in the

case.

7. Report in this regard be filed on the adjourned day.

8. Let the matter appear under the same heading on 09.01.2025.
