1. Leave granted.

2. The appellant has been chargesheeted for

the offences punishable under Sections

120B, 406, 409, 420, 201, 468 and 471 of

the Indian Penal Code, 1860 read with

Sections 7A, 12, 13(1)(a) and 13(2) of the

Prevention of Corruption Act, read with

Section 8 of the Assam Fiscal

Responsibility and Budget Management Act,

2005 and read with Section 41 of the Assam

Public Procurement Act, 2017.

3. We are inclined to interfere with the

impugned order on two grounds, namely, the

appellant being a lady is suffering from

Reason:

medical health issues, and the fact that

she has been under incarceration for nearly

two years. We record the submission made by

the learned senior counsel appearing for

the respondent that further investigation

is still pending.

4. For the reasons aforestated, we are

inclined to set aside the impugned order

and grant bail to the appellant by making

it clear that the appellant shall continue

to cooperate with the pending investigation

till its conclusion.

5. Accordingly, the impugned order stands set

aside and the appellant is granted bail,

subject to the terms and conditions that

may be imposed by the Trial Court.

6. The appeal is allowed.

7. Pending application(s), if any, shall stand

disposed of.
