For Appellant(s) : Mr. Rajesh Kumar Parashar

HON’BLE THE CHIEF JUSTICE MR. MANINDRA MOHAN SHRIVASTAVA
HON’BLE MR. JUSTICE CHANDRA PRAKASH SHRIMALI
Order

14/07/2025

1. Heard.

2. Challenge to the transfer order is based on hardship and not

on the grounds of illegalities and mala fides. Legal position with

regard to this is well settled. Reliance placed on order dated

07.05.2025 passed in the case of Choti Devi vs. State of

Rajasthan & Ors. is misconceived on facts. In that case, on

facts, the Court found extreme hardship, that is not here. The

appellant’s remedy lies in making representation.

3. With the liberty to file representation, the appeal is

dismissed.
