[2025:RJ-JP:26069-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Special Appeal Writ No. 828/2025 Shankuntala Koli Daughter Of Late Shri Hajari Lal Koli, Aged About 50 Years, Resident Of Ward No. 7, Shahpura, Bhilwara, Rajasthan. ----Appellant Versus 1. The Principal Secretary, Department Of Medical And Health, Government Secretariat, Jaipur, Rajasthan 2. The Director (Non-Gazetted) And Additional Director, (Administrative), Department Of Panchayati Raj (Health), Rajasthan, Jaipur. ----Respondents
For Appellant(s) : Mr. Rajesh Kumar Parashar
HON’BLE THE CHIEF JUSTICE MR. MANINDRA MOHAN SHRIVASTAVA
HON’BLE MR. JUSTICE CHANDRA PRAKASH SHRIMALI
Order
14/07/2025
1. Heard.
2. Challenge to the transfer order is based on hardship and not
on the grounds of illegalities and mala fides. Legal position with
regard to this is well settled. Reliance placed on order dated
07.05.2025 passed in the case of Choti Devi vs. State of
Rajasthan & Ors. is misconceived on facts. In that case, on
facts, the Court found extreme hardship, that is not here. The
appellant’s remedy lies in making representation.
3. With the liberty to file representation, the appeal is
dismissed.
