1. Heard learned counsel for the parties.
2. The present appellant was convicted and sentenced to
imprisonment for life and fine of Rupees five thousand with
default stipulation by the Trial Court for the offences
punishable under Sections 302 read with Section 34 of the
Indian Penal Code. His appeal before the High Court has also
been dismissed. Being aggrieved, the appellant is before this
Court.
3. However, today we have been informed that after
undergoing the necessary period of incarceration, the
appellant has prematurely been released under the policy of
remission.
4. Under these circumstances, learned counsel for the
appellant rightly submits that he would not argue the present
appeal.
