1. The instant writ petition has been filed by one of the parents of the
students of Janapriya Higher Secondary School, Bholarbhita, West Garo
Hills, being aggrieved with a Resolution dated 13.07.2024, whereby a
Special Managing Committee has been approved. Submissions of the
petitioner is that the said approval for the Special Managing Committee
without the constitution of a regular Managing Committee is illegal and
arbitrary, and therefore, the same is liable to be interfered with by the orders
of this Court.
2. Mr. S. Sen, learned GA for the respondents No. 1-4, however has
made a concession and submits that as the dispute is ongoing, the

2025:MLHC:707respondents No. 3 and 4 may be allowed to re-examine the matter and take
appropriate steps for reconstitution of a regular Managing Committee at the
earliest.
3. Dr. N. Mozika, learned Senior counsel assisted by Mr. M.L.
Nongpiur, learned counsel for the respondent No. 5 submits that as it is in
the interest of the school of the students, he has no objection to the
suggestion made by Mr. S. Sen, learned GA.
4. In view of the concessions made by both the parties, this writ petition
is disposed of by directing the respondents No. 3 and 4 to examine the
matter by giving adequate opportunity of hearing to both the parties and
thereafter to take appropriate steps thereon, for constitution of a regular
Managing Committee.
5. It is expected that the entire exercise should be completed preferably
within a period of 2(two) months from the date of receipt of this order by
the respondents No. 3 and 4. However, it is provided that till further orders
are passed by the respondents No. 3 and 4, status quo shall be maintained as
on today.
6. Matter accordingly stands closed and disposed of.
