1) The present writ petition has been filed by the petitioner with the

following relief(s) :

“10.1 That, the Hon’ble Court may kindly be pleased

to quash/set aside the order dated 06.02.2025

(Annexure P/1) and to direct the respondent

authorities to revoke the order of suspension and

reinstate the petitioner in service along with all the

consequential benefits.

10.2 Any other relief, deemed fit in the present facts

and circumstances of this case may also be awarded

to the petitioner.”

2) Learned counsel appearing for the petitioner submits that by the

impugned order dated 06.02.2025 (Annexure A/1), the petitioner

who was working as Assistant Chief Supervisor and at present

posted at In-charge Branch Manager, District Cooperative Central

Bank Maryadit, Branch Shankargarh, District Balrampur –

Ramanujganj (C.G.) has been placed under suspension. He submits

that the service condition of the petitioner is governed by the

Chhattisgarh Zila Sahkari Kendriya Bank Karamchari Sewa

(Niyojan, Nibandhan Tatha Unki Karya Sthithi) Niyam, 1982 and

according to Sub-Rule 6 & 7 of the Rule, 60, if the charge-sheet is

not supplied to the delinquent employee within a period of 45 or

90 days, her/his suspension would automatically revoked. Till

today, the charge-sheet has not been supplied, but the petitioner is

still paged under suspension. He further submits that ventilating

his grievances, he has submitted representation dated 16.05.2025

to the respondent No.2 which, till date has not been decided.

Therefore, for the present, this writ petition may be disposed of

directing the respondent No.2 to decide the representation dated

16.05.2025 (Annexure P-2) or to permit the petitioner to make a

fresh representation with regard to grievances raised in this writ

petition.

3) The proposition made by learned counsel for the petitioner has not

been opposed by the learned counsel for the respondents.

4) Be that as it may, at this stage, this writ petition is disposed of

permitting the petitioner to make a fresh representation within 10

working days from today before the respondent No.2 who is

expected to decide the same within a further period of 30 days

from the date of receipt of such representation in accordance with

law and the rules governing the service conditions of the petitioner.

Needless to say this Court has not expressed any opinion on the

merits of this case.

5) The grievances of the petitioner still subsist, he may take recourse

available under the law.

6) As a sequel, interlocutory application(s), if any pending, shall

stand(s) disposed of.
