Mr. K. Paul, learned Senior counsel assisted by Mr. S. Chanda,
learned counsel has specially appeared today on behalf of the petitioner,
with regard to the affidavit filed by the respondent No. 14, wherein certain
allegations have been made against the counsel appearing for the
petitioner. The learned Senior counsel has taken this Court through the
various averments made therein, which he submits has cast a stigma on the
said counsel and also will affect the adjudication of the matter.

The affidavit which is stated to be objectionable, has been perused
by this Court and indeed it is noted and seen, that certain statements have
been made therein, which has cast severe aspersions and has attributed
wrongdoing on a counsel appearing for the petitioner in this matter, which
are very serious in nature.

On the observation made by the Court that the averments made in
the affidavit are totally uncalled for and unwarranted, and if any grievance
the respondent might have against the counsel, adequate alternate
procedures exist in law, Mr. Y. Bhama, appearing in person for the
respondent No. 14, prays that he may be allowed to withdraw the affidavit
and that the same be expunged from the records.

The prayer of Mr. Y. Bhama, appearing in person for the respondent
No. 14, is considered and the affidavit is allowed to be withdrawn and
taken-off the records. However, a note of caution and warning is necessary
to be recorded, that personal grievances cannot and should not, be aired in
the manner as portrayed in the affidavit by the respondent No. 14, herein
or by any litigant before this Court, inasmuch as, the same tarnishes the
image of the entire legal fraternity.

The respondent No. 14 however, is permitted to file a rejoinder
affidavit, on merits.

Accordingly, list this matter on 25.08.2025.
