[1] Present Mr. HS. Paonam, learned senior counsel assisted
by Mr. S. Gunabanta, learned counsel, Mr. Ch. Robinchandra and Mr. M.
Rendy, learned counsel for the petitioners, Mr. M. Rarry, learned senior
counsel assisted by Ms. Nikita, learned counsel for the State respondent
Mr. S. Jasobanta, learned counsel and Mr. Gunindro, learned counsel
appearing on behalf of the office of the Principal Accountant General
Manipur.
[2] In these batch of writ petitions, the issue involved is
recovery of the excess payment made by the authority to the employees.
[3] It is submitted by the learned counsel appearing for the
petitioners that the Hon’ble Supreme court and Division Bench of this
Court especially held that the excess recovery cannot be made in certain
cases.
[4] However, Mr. M. Rarry, learned senior counsel appearing
for the State respondent, submits that there are some areas which are not
covered by the Hon’ble Supreme Court or Division Bench of this Court. In
the circumstances, Mr. M. Rarry, learned senior counsel, is permitted to
make a classification as to whether: (i) the case covered by the Hon’ble
Supreme Court order, (ii) the case covered by the Division Bench of this
Court and (iii) the cases not covered by both the directions.
[5] The classification may be submitted before the next date of
hearing with an advance copy to the other side.
[6] Learned counsel for the petitioners are also permitted to file
a short synopsis as to whether the cases are covered by the decision of
the Hon’ble Supreme Court or Division Bench of this Court with an
advance copy to the learned counsel for the respondents.
[7] List this case on 24.02.2025.
