Heard Mr. L. Khyriem, learned counsel for the petitioner who has
submitted that the petitioner being aggrieved and dissatisfied with the order
dated 03.07.2025 passed by the Executive Committee, Khasi Hills Autonomous
District Council, whereby on the basis of an inquiry conducted against the
petitioner and an inquiry report filed by the Inquiry Officer, the findings thereof
being the subject matter of the decision made by the said Executive Committee,
the petitioner has been removed from the office of Syiem of Hima Nongspung
with immediate effect.

This decision of the Executive Committee was followed by a notification
whereby the removal of the petitioner as Syiem of Hima Nongspung has been
made widely known. It is the submission of the learned counsel that the inquiry
conducted against the petitioner is faulty inasmuch as the charges framed

against the petitioner in such inquiry, out of the charges numbering about
8(eight) charges, two of such charges that is, charge No. 3 and charge No. 6
have not been proved whereas the other 6(six) charges have been proved against
the petitioner, but in course of such inquiry, there are found glaring
inconsistency and non-consideration of the factual situation by the Inquiry
Officer as against the claim of the petitioner, as such, the inquiry proceedings
is vitiated. Hence this petition.

On consideration of the submission of the learned counsel for the
petitioner, this petition is hereby admitted.

Mr. C.C.T. Sangma, learned counsel appearing vice Mr. T.T. Diengdoh,
learned Special Counsel, Khasi Hills Autonomous District Council has
accepted notice on behalf of the respondent Nos. 1-3 respectively as such, no
formal notice is required to be issued upon such respondents. The petitioner is
directed to take steps for issuance of notice upon the respondent Nos. 4-12
respectively. The notice is returnable within 2(two) weeks.

The respondent Nos. 1-3 are at liberty to file their counter affidavit on
the next date.

List this matter for further orders after 2(two) weeks.
