applicant/writ petitioner, Mr.Nepolean, learned Government Advocate
for State and Mr.N.Ibotombi, learned senior counsel for respondent

The petitioner in WP(C) No.268 of 2024 has filed the
present application i.e. MC (WP(C)) No.564 of 2025 for staying the
order dated 25.6.2025 issued by the Registrar of Societies, Manipur
appointing Shri Ksh Bikramjit Singh, ARCS (Admin), RCS Office as
Liquidator with immediate effect for winding up of “Radha Krishna
Mandir, Prabandhak Karya Karni Committee, Regd No.11 of 1960-61.
It is submitted that appointment of fresh Liquidator during
pendency of the writ petition will prejudice the case of the petitioner.
On the other hand, Mr.S.Nepolean, learned Government
Advocate and Mr.N.Ibotombi, learned senior counsel for respondent
No.3 draw attention of this Court to order dated 13.2.2025 passed in
MC (WP(C)) No.230 of 2024 where this Court refused to stay the
appointment of Liquidator. However, it was observed that such
appointment would be subject to the outcome of the writ petition.
Learned senior counsels have pointed out that the main
prayers in the writ petition are challenge to the appointment of
Liquidators by various orders and latest order dated 25.6.2025 is also
an order to appoint fresh Liquidator due to retirement of earlier
incumbent.
It is submitted that earlier order dated 13.2.2025 still
prevails and the present application is barred by the earlier order.
This court has perused the materials on record and the
main prayer in the writ petition is for stay/cancellation of the
appointment of Liquidator. Vide order dated 13.2.2025 this Court has
already observed that the appointment of Liquidator would be subject
to the outcome of the writ petition. The latest order dated 25.6.2025
sought to be stayed is also for appointment of Liquidator upon
retirement of earlier Liquidator.
In the circumstance, the application is dismissed being
devoid of merit.
