Oral:

1. Ms. A. Kharshiing, learned counsel for the petitioner today submits

that 80% of the bill amount has since been released to the writ petitioner

and the balance 20% she submits will be subject to the outcome of an

inquiry, which was constituted by the Executive Council. Learned counsel

has also referred to Para – 10 of the affidavit-in-opposition, and prays that

the matter may be closed and the outcome be subject to the inquiry.

2. Mr. S. Sen, learned counsel for the respondents has no objection to

the prayer made by the learned counsel for the writ petitioner.

3. Accordingly, on the submissions made by the learned counsel for the

petitioner, this matter stands closed with the petitioner, to await the outcome

of the inquiry and for further adjustments as per clause – 2 of the

Agreement due to the delay of the completion of the work.

4. It is expected that the entire matter shall be concluded within a period

of 3(three) months.

5. The learned counsel submits that the writ petitioner also reserves his

right to approach this Court, if still aggrieved, which is noted.

6. Matter accordingly stands closed and disposed of.
