This is a petition filed under Section 25 of the Code of

Civil Procedure, 1908 (for short “CPC”). The petitioner is the

wife of the respondent.

The petitioner has filed this transfer petition seeking

the following reliefs:

“a) allow the transfer petition filed by the petitioner
seeking transfer of O.P. No.440 of 2024 titled as
“Rahul Krishnan. K Vs. Shruthi. S” pending before the
Family Court, Kunnamkulam, Kerala to Subordinate Court
Poonamalee, Tamil Nadu on considering the facts and
circumstances of the case as narrated in the above; and

b) pass such further other order or orders as this
Hon’ble court may deem fit and proper in the abvoe
said facts and circumstances of this case.”

On perusal of the office report, it is noted that the

service of notice was effected on the respondent on 10.01.2025.

However, there is no representation on behalf of the respondent.

Having heard learned counsel for the petitioner and on

perusal of the material on record, we find that the petitioner

has made out a case for transfer of the aforesaid petition.

In the result, the transfer petition is allowed and O.P.

No.440 of 2024 titled as “Rahul Krishnan. K Vs. Shruthi. S”

pending before the Family Court, Kunnamkulam, Kerala is ordered

to be transferred to Subordinate Court Poonamalee, Tamil Nadu.

Registry to communicate this order to the transferor as

well as the transferee courts for taking steps in accordance

with this order.
