The present Regular Bail Applicat ion under
Sect ion 483 of t he Bharat iya Nagarik Suraksha Sanhit a,
2023 has been filed in connect ion wit h t he Case Crim e
No.525 of 2024, regist ered at Kot wali Roorkee, Dist rict
Haridwar under Sect ions 112, 317( 2) and Sect ion 3( 5)
of t he Bharat iya Nyaya Sanhit a, 2023.
2. The applicant and a co- accused snat ched a
golden chain of t he inform ant on 08.08.2024 and ran
away. They sold t he said chain. Rs.10,000/ – ( Rupees
Ten Thousand) each were recovered from t heir
possession.
3. Heard Mr. Tapan Singh, learned counsel for
applicant and Mrs. Manisha Rana Singh, learned Deput y
Advocat e General for respondent .
4. Mr. Tapan Singh, Advocat e, has cont ended
t hat t he applicant has been falsely im plicat ed in t he

present m at t er. The co- accused of t he sim ilar role has
been released on bail by t he Magist rat e. Applicant is
not a previous convict . He is a perm anent resident of
Dist rict Saharanpur, t herefore, t here is no likelihood of
his absconding, and, he is in cust ody since 19.09.2024.
5. Mrs. Manisha Rana Singh, learned Deput y
Advocat e General has opposed t he bail applicat ion
orally.
6. Having considered t he subm issions of learned
counsel for bot h t he part ies and in t he fact s and
circum st ances of t he case, wit hout expressing any
opinion as t o t he m erit of t he case, t his Court is of t he
view t hat t he applicant deserves bail at t his st age.
7. The Bail Applicat ion is allowed.
8. Let t he applicant – Shubham Mishra be
released on bail on his execut ing a personal bond and
furnishing t wo reliable suret ies, each in t he like
am ount , t o t he sat isfact ion of t he court concerned.
