UPON hearing the counsel the Court made the
following
O R D E R
1. Heard learned counsel for the parties and
perused the pleadings exchanged by the parties.
2. The petitioner is involved in a case under
the Narcotic Drugs and Psychotropic Substances Act
and it is alleged that he was illegally
transporting 79kg of Ganja.
3. All the three prime witnesses, PW-1, PW-2 and
PW-3 have turned hostile. The petitioner has
already suffered incarceration for a period of two
and half years. The trial is likely to take some
more time.
4. In the facts and circumstances of the case,
we are of the opinion that the petitioner deserves
to be enlarged on bail. Accordingly, we direct
that the petitioner be enlarged on bail subject to
the terms and conditions as may be imposed by the
Trial Court commensurating with the charges framed
against him. However, the petitioner shall

cooperate and participate with the Trial.
5. The special leave petition stands disposed of
in the above terms.
6. Pending application(s), if any, shall stand
disposed of.
